Pavia e Ansaldo wins again for Lime in micromobility sharing services in Milan

Milan, June 14, 2024 – Pavia e Ansaldo, with partner Marco Giustiniani, senior associate Antonello Frasca and associates Alessandro Paccione and Cristiano Piroli, assisted LIME Technology in the precautionary proceedings before the Regional Administrative Court for Lombardy and the Council of State, concerning the orders of forfeiture of the authorization to carry out the scooter sharing service, adopted by the Municipality of Milan, against two other operators in the sector and the consequent issuance of the new authorization in favour of LIME, moving down the ranking list of the tender held in 2023 by the same Milanese Administration.

In two articulated orders, accepting the arguments of Lime and the Municipality of Milan, the Lombardy Regional Administrative Court (with reasons later confirmed during the appeal also by the Council of State) rejected the precautionary applications proposed by Lime’s two competitors, recognizing the legitimacy of the relevant forfeiture measures, taking into account that, at the time of the start of the activity, the applicants’ fleet of scooters was lacking the characteristics for which they had obtained prize scores, which made them win the authorizations to operate the sharing activity.

The sentences of the Lombardy Regional Administrative Court and the Council of State follow a few months later those of the Lazio Regional Administrative Court, the Piedmont Regional Administrative Court, the Emilia-Romagna Regional Administrative Court and the Sicily Regional Administrative Court on the tenders called by the cities of Rome, Turin, Rimini and Palermo, where LIME – again assisted by Pavia and Ansaldo – was victorious at the outcome of the relevant lawsuits.
